Terms All sales of products and/or services (“Goods”) at or through www.CodeBleu.com or affiliated websites (“Code Bleu.com”) are governed by and subject to these sales terms and conditions (the “Terms”). By placing an order or making a purchase through CodeBleu.com, the buyer (hereinafter “Buyer”) accepts the Terms and agrees to be governed by and subject to the Terms.

Orders All orders by Buyer constitute offers subject to final acceptance by Code Bleu and/or its wholly-owned subsidiaries. Code Bleu may require additional information before processing an order. An order confirmation confirms receipt of an order and does not signify Code Bleu’s acceptance of the order. Code Bleu reserves the right to accept or decline an order at any time for any reason. Code Bleu may, in its sole discretion, limit order quantities. If Code Bleu cancels an order after billing, Code Bleu will refund the billed amount.

Once placed by the customer, orders made on CodeBleu.com cannot be canceled. You may return your unwanted, unused product to Code Bleu pursuant to Code Bleu’s return policy, which may be found on our website.

For all purchases made at CodeBleu.com, sales tax will be charged according to the state where the product is shipped. If the Buyer is tax-exempt and has a valid tax-exempt number, the Buyer should contact Customer Care in advance of placing the product order and be prepared to provide a PDF of the documentation. Code Bleu’s Customer Service shall not process any refunds for sales tax already paid for purchases made at CodeBleu.com or through Code Bleu’s Customer Service.

It is Code Bleu's company policy that sales tax amounts are non-refundable, and it is the Buyer’s responsibility to request a refund from the appropriate state authority.

Please refer back to your accounting department for the proper filing on any taxes paid.

Prices 

​

Prices shown on CodeBleu.com do not constitute offers. Code Bleu reserves the right to change prices at any time without notice and to correct pricing errors. If an item purchased for full price goes on sale within fourteen (14) days of purchase, Code Bleu will refund the difference upon request. Code Bleu does not match prices from unauthorized resellers or inconsistent pricing with Code Bleu’s resale policies. Shipping and handling, expedited service, and taxes are not included in prices and will be added to the total if applicable.

Shipping Estimations Orders will ship as soon as practicable after the completed order is received and payment is processed, unless otherwise noted at the time of the order or in case of a delay notification. Preorders will ship at a future date. Any expected delivery dates given are estimates. Delays may occur due to verification or the timing of the order placement. Orders may be delivered in separate shipments. All purchases through CodeBleu.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier.

Shipping of non-Dangerous Goods to certain locations, such as Alaska, Hawaii, Puerto Rico, and other territories, may take additional time compared to shipments within the continental U.S. Restrictions may apply to certain international locations and items like lithium-based battery products.

Shipping Restrictions 

​

Due to standalone lithium-based battery shipping restrictions, such products may only ship via ground and are subject to domestic and international shipping requirements. Orders that cannot be shipped via ground may be subject to cancellation. U.S. domestic orders to Alaska, Hawaii, Puerto Rico, and the Virgin Islands are subject to similar restrictions. International shipments of these items are prohibited.

Delivery

Estimated delivery dates are not guarantees. Deliveries are subject to modification or cancellation due to events beyond Code Bleu’s reasonable control, including but not limited to acts of God, compliance with governmental or regulatory requirements, transportation delays, labor disputes, strikes, equipment failures, and material shortages. Risk of loss and title pass to Buyer when the item is handed to the carrier.

Code Bleu reserves the right to cancel or decline an order or payment method at any time for any reason. Coupon codes may be void for gift cards, specially priced products, and new product releases.

Refunds & Returns 

 

If you are dissatisfied with your purchase, follow our return directions within 30 days of purchase for a full refund, credit, or exchange. Custom items are not returnable and cannot be canceled once the order is placed.

For warranty issues, submit a claim within your account on our website at any time during the warranty period. A valid credit card may be required for the replacement. Claims for damaged or missing items must be received within two business days of receipt.

Counterfeits 

 

Code Bleu is committed to offering authentic, high-quality products. Products purchased directly from www.CodeBleu.com or authorized partners carry our warranty. Counterfeit products are not covered, and Code Bleu assumes no liability for such items.

Limited Warranty 

 

Any applicable limited warranty is available to the original retail purchaser only. For applicable warranty terms, review the original packaging or visit www.CodeBleu.com/warranty.

Limitations on Liability 

 

THERE IS NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE BEYOND WHAT IS REQUIRED BY LAW. ANY IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE TERM OF THE WRITTEN WARRANTY. REPAIR, REPLACEMENT, OR REFUND IS THE EXCLUSIVE REMEDY PROVIDED UNDER THE WARRANTY. CODE BLEU WILL NOT BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR PROPERTY DAMAGE. CODE BLEU'S LIABILITY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE. BUYER ACKNOWLEDGES AND AGREES TO THESE LIMITATIONS AS A CONDITION OF THE SALE.

Consumer Rights Some states do not allow limitations on implied warranties or the exclusion of certain damages. These limitations may not apply to every Buyer. These Terms give specific legal rights, and the Buyer may have other rights depending on their jurisdiction.

Modifications Changes to these Terms must be made in writing and signed by an authorized officer of Code Bleu. Code Bleu does not accept any additional terms or conditions unless expressly agreed upon in writing.

Intellectual Property 

 

Buyer acknowledges that all trademarks, copyrights, patents, designs, and other intellectual property related to Code Bleu products are the sole property of Code Bleu, and Buyer has no right or interest in such intellectual property.

​

Indemnity 

 

Buyer agrees to indemnify and hold Code Bleu, its officers, agents, employees, and representatives harmless from any claims, liabilities, damages, and expenses, including attorney fees, arising from the use or resale of Code Bleu products. Buyer agrees to defend Code Bleu from any such claims at its own expense.

Applicable Law 

 

These Terms will be governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in California courts. Buyer waives the right to a jury trial or class action.
